The firm successfully represented the sponsor of a one hundred seventy-seven (177) unit luxury estate home golf course community in Suffolk County, New York in a lawsuit commenced by the homeowners' association seeking to recover damages for alleged construction defects and alleged miscalculations in the deficiency budget contributions required to be made by the sponsor to the homeowner' association during the period of time the sponsor remained in control of the Board. Partner, David I. Rosenberg, Esq. and associate, Anthony R. Filosa, Esq., represented the defendants and following an eleven (11) day trial, the Court, in a written decision, dismissed the entire lawsuit against the sponsor and the sponsor-designated members of the homeowners' association Board.
